Terms and Conditions
1. Who these terms are from
These terms apply to all services by Jesse Heffels, based in Roermond, the Netherlands (Chamber of Commerce / KvK number 70677638), hereafter "I" or "me". "You" means the company or person who hires me. Contact: viral@jesseheffels.com.
2. When they apply
These terms apply to every quote, proposal and agreement for my services, such as short-form video production, content strategy and hosting or MC work. Anything we agree on in writing for a specific project (for example in a proposal or email) takes priority over these general terms. Your own general terms do not apply unless I accept them in writing.
3. Quotes and agreements
Quotes are valid for 30 days unless stated otherwise. An agreement starts once you accept a quote or proposal in writing, by email is fine.
4. How we work together
- I plan, film and edit the content as agreed in the proposal. Timelines are estimates and depend on shoot dates and the availability of locations and people.
- You make sure I get the access, information, locations and approvals needed to do the work, on time.
- Each project includes the rounds of feedback stated in the proposal. Extra changes, extra videos or extra shoot days are charged separately, after we agree on them.
- I share professional advice on content and posting, but I cannot guarantee specific results such as a number of views, followers or sales. Reach on social media depends on platforms and algorithms outside my control.
5. Prices and payment
- Prices are as stated in the quote, in euros and excluding VAT, unless stated otherwise.
- Travel and accommodation for projects outside the Netherlands are agreed in advance and are either paid by you or included in the price.
- Payment terms are agreed per project and stated on the invoice. For larger projects part of the fee may be invoiced in advance.
- If an invoice is not paid by the agreed date, I may pause the work until it is paid, and statutory interest and reasonable collection costs may apply.
6. Cancelling or rescheduling
If you cancel or move a shoot date, please let me know as early as possible. Costs already made (such as non-refundable travel) are charged. If you cancel a confirmed project, work already done is charged pro rata, and for cancellations within 7 days of a planned shoot day, that shoot day is charged in full. If I cannot make a shoot day because of illness or another serious reason, we plan a new date together at no extra cost.
7. Usage rights
- Once the invoice is paid in full, you get a full, unlimited and perpetual licence to use the delivered videos on any platform, in ads, on your website and anywhere else, at no extra cost.
- I keep the copyright and the right to show the work in my portfolio, on my website and on my own channels, unless we agree otherwise in writing.
- Raw footage and project files are not included, unless agreed otherwise.
- You are responsible for the permissions for anything you provide, such as logos, music, products and people from your own team appearing in the videos.
8. Posting on your account
If you give me access to your social media accounts to post for you, I only use that access for the agreed work and do not change anything else. You can revoke access at any time. You stay responsible for your accounts and their content.
9. Liability
My liability is limited to the amount invoiced for the project in question, and does not cover indirect damage such as lost profit or missed revenue. This limit does not apply in case of intent or gross negligence.
10. Confidentiality
We both keep confidential information about each other's business private, unless it is already public or we agree otherwise.
11. Law and disputes
Dutch law applies. If we ever disagree, we will first try to solve it together. If that does not work, the competent court in the district where I am based will decide.
